SpeakCal Terms of Service

These Terms of Service ("Terms") govern your use of the SpeakCal mobile application ("the App"). By installing or using the App, you agree to these Terms.

1. The App

SpeakCal is a voice-first calorie and nutrition tracking application for iOS. It uses on-device speech recognition, AI-powered food entity extraction, and verified nutrition databases to make food logging fast.

The App is not a medical device, weight-loss program, eating-disorder treatment tool, or substitute for advice from a qualified health professional.

2. Eligibility

You must be at least 13 years old to use the App.

If you are between 13 and 18 (or the age of majority in your jurisdiction), you confirm that your parent or legal guardian has reviewed and accepted these Terms on your behalf.

3. Subscriptions and payments

3.1 Free tier

The App has a free tier that includes basic meal logging with daily limits.

3.2 Premium subscription

A premium subscription unlocks unlimited meal logging and additional features. Pricing is shown in the App at the time of purchase.

3.3 Auto-renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel at any time via your iPhone Settings → Apple ID → Subscriptions.

3.4 Refunds

Refunds for in-app purchases are handled by Apple under their App Store refund policy: https://support.apple.com/HT204084. We do not process refunds directly.

3.5 Free trial

If a free trial is offered, you will not be charged until the trial period ends. Cancelling before trial end means no charge.

8. Intellectual property

8.1 Our content

The App, including its design, code, branding, and original content, is owned by us and protected by copyright, trademark, and other laws. You may not copy or redistribute it without permission.

8.2 Your content

You retain ownership of meals, symptoms, and notes you create in the App. You grant us a limited license to store and process this content solely to provide the App's functionality.

8.3 Food data attribution

Food and nutrition data displayed in the App may originate from USDA FoodData Central (public domain), Open Food Facts (Open Database License), and/or FatSecret (with attribution). Where required, we display attribution within the App's Settings.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE APP, INCLUDING LOST PROFITS, LOST DATA, OR HEALTH DECISIONS MADE BASED ON THE APP'S OUTPUT.

OUR TOTAL LIABILITY IN ANY CIRCUMSTANCE IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRIOR TO THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

11. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for legal or operational reasons.

You may terminate your use at any time by uninstalling the App and (if you have an account) requesting account deletion via hello@speakcal.app.

Upon termination, the licenses granted to you under these Terms end immediately. Sections 5, 8.1, 8.3, 9, 10, 12, and 13 survive termination.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will:

  2. Post a notice in the App's release notes
  3. For material changes, send an in-app notification

Your continued use of the App after a Terms change means you accept the updated Terms. If you do not agree, you must stop using the App.

13. Governing law and disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws principles.

Any dispute arising under these Terms will first be addressed informally by emailing hello@speakcal.app. If informal resolution fails within 30 days, disputes will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.

You waive your right to a jury trial or to participate in class actions, except where prohibited by applicable law.
